We provide comments regarding NIST’s assignments under Sections 4.1, 4.5 and 11 of the Executive Order Concerning Artificial Intelligence (Sections 4.1, 4.5, and 11).

In NIST’s implementation of the Executive Order 13960 on “Promoting the Use of Trustworthy Artificial Intelligence in the Federal Government” (EO), we recommend consideration of the following: military and national security use-cases, minimum criteria for unacceptable risks, responsibility for managing risks, red-teaming, guidance for 'open' models, synthetic content, and the definition of “dual-use foundation models”.
